Privacy Policy
How website information, direct enquiries and service-related information are handled, including the browser-only project form.
1. Scope and business contact
This policy describes how Kensley Momentum handles information in connection with its website and social media management services. Our company began operating on October 1, 2026. It covers visitors, people who contact us directly and business representatives involved in a service engagement. It does not replace a client-specific data-processing agreement where one is needed.
Kensley Momentum is the contact for questions about these practices. Our contact address is 303 N Broadway, Billings, MT 59101, our email is projects@kensleymomentum.com and our phone is +14069469744. This is a business contact address; this policy does not represent it as a public walk-in office or promise in-person services.
2. Information entered in the website form
The website’s project-brief form checks the fields you enter, creates an enquiry reference and displays a confirmation within your browser. In the supplied Custom Liquid configuration, there is no form-delivery endpoint, email-sending function, database submission or customer-management integration. Completing the form does not itself provide the entered information to Kensley Momentum.
Form values are held temporarily in the page while you use it and are cleared after a successful local confirmation. The theme does not write those values to cookies, local storage or session storage. Your browser may independently offer autofill or save information according to its own settings. Close the page or clear the fields if you share a device.
3. Information you actually send to us
If you email, telephone or otherwise contact us directly, we receive the information you choose to provide. It may include your name, business name, contact details, social account identifiers, service interests, project description and correspondence. An invoice or engagement may also involve business billing details, payment status and agreement records.
Do not send passwords, full payment-card details, government identification, health information or unrelated customer data in an enquiry. We ask for information relevant to discussing or delivering the service. If a later engagement requires access to private account data, the access and purposes should be separately agreed before it is provided.
4. Website requests and technical information
This website is hosted on Shopify. Delivering pages can involve technical information such as an IP address, browser information, requested URL, request time and security or error records. Shopify, the active theme and configured apps may operate platform-level functions, including essential cookies and analytics according to the store’s settings. Those functions are separate from the browser-only project form.
The supplied Kensley Momentum Custom Liquid blocks do not add advertising pixels, third-party analytics, social-media embeds or external font services. Their images and fonts are uploaded to Shopify Files and served by Shopify. The site operator must review the actual live Shopify configuration, including apps and customer privacy settings, and keep disclosures accurate when that configuration changes.
5. Why received information is used
Information actually received through direct contact may be used to answer questions, prepare proposals, identify the correct business representative, plan work, provide agreed services, issue invoices, manage approvals and address service concerns. Technical information may be used to operate and secure the website. We do not treat a general enquiry as permission to send unrelated marketing campaigns.
Service information should be used for the engagement for which it was provided. For example, access to an account may be used to prepare or publish approved content and review agreed analytics. A separate use, such as publishing a client quote or identifying a business in promotional material, requires appropriate permission.
6. Our basis for handling information
Where applicable privacy law requires a legal basis, relevant bases may include taking steps at your request before an agreement, performing the agreed service, meeting legal obligations and legitimate interests in operating a secure business and communicating with authorised contacts. Consent is used where a specific activity legally requires it.
The applicable basis depends on the information, activity and jurisdiction. Where consent is the basis, you may withdraw it prospectively without changing the lawfulness of earlier processing. We do not present checkbox consent as a blanket waiver of privacy rights or as permission for every possible future use of your information.
7. Service providers and other recipients
Information actually received may be handled by providers supporting business email, hosting, document storage, accounting or agreed social media tools. Access should be limited to the purpose for which the provider is used. We may also disclose information where reasonably necessary to meet a legal obligation, respond to lawful process or protect rights and security.
We do not sell personal information or exchange it for cross-context behavioural advertising in the supplied website configuration. Social platforms process information under their own terms when you use an account or approve publication. A provider is not authorised to use our website merely because it appears in a service description; actual integrations require a separate operational assessment.
8. Client account data and private messages
A social media engagement may involve platform analytics, account identifiers, published content and, if specifically included, comments or private messages. The client remains responsible for the lawful operation of its accounts and for determining the authorised purposes. We use agreed permissions and instructions to carry out the service.
Where we act as a processor or service provider for client-controlled personal information, that role should be documented in the engagement and any required processing agreement. Private-message handling is not automatically included in every service. Access should be limited, sensitive requests should be escalated, and credentials should be removed when the authorised work ends.
9. Retention and deletion
Browser-only project form values are not retained by the supplied Custom Liquid blocks after the local form is reset. Information sent directly to us may be retained while an enquiry or engagement is active and afterwards for a period reasonably needed for records, disputes, accounting or applicable legal obligations. Retention should depend on the purpose rather than an indefinite default.
You may ask about information we hold and request deletion where applicable. Deletion may be limited by legal obligations, an unresolved dispute or records necessary to establish what was agreed. Backup copies may remain until normal rotation removes them, subject to access restrictions. We should not retain account permissions after they are no longer needed.
10. Security and shared devices
Reasonable safeguards should match the information and access involved. These include limiting access to authorised users, using business permissions rather than unnecessary password sharing, applying appropriate account security and avoiding collection of sensitive information that is not needed for the work. No website or communications system can be guaranteed completely secure.
You are responsible for protecting your own devices and account credentials. If you believe that an account has been compromised, revoke unnecessary access through the platform and notify the relevant providers promptly. Do not include confidential account recovery details in a public website enquiry. Contact us directly about an engagement-related access concern.
11. Your choices and applicable rights
You may choose not to provide information, although we may then be unable to prepare a useful proposal or perform a requested service. Depending on the law that applies to you and our processing, you may have rights to access, correct, delete or obtain a copy of certain information, restrict or object to processing, or withdraw consent.
Send a request to projects@kensleymomentum.com and explain what you are asking us to do. We may request proportionate verification of identity or authority and will respond within applicable legal time limits. Where an appeal or complaint right is required, we will explain it. We do not require payment merely for an ordinary valid request unless law permits a specific exception.
12. Cookies and browser privacy controls
The Cookie Policy describes cookies and similar technologies for this website. The supplied Custom Liquid blocks do not add advertising cookies or tracking tools. Shopify, the active theme and configured apps may use necessary functions and platform analytics in accordance with the store's actual settings. The local project form does not depend on a marketing cookie.
Browser controls can block or remove cookies, limit autofill and clear site data. Blocking necessary functions may affect store features. The operator should assess Shopify customer privacy controls, relevant browser signals and any added integrations for the live configuration. These Custom Liquid blocks do not create cross-context advertising profiles.
13. Children and sensitive information
The website is directed to businesses and their authorised adult representatives. We do not design the service to solicit personal information from children. If you believe a child has sent us information directly, contact us so the circumstances can be reviewed and appropriate action taken.
We do not ask visitors to provide sensitive personal information in the project form. Client content may relate to regulated sectors, but that does not make us a healthcare, financial or legal adviser. A client proposing work involving sensitive customer information must identify that need before sharing data so the required boundaries can be agreed.
14. Location of providers and policy changes
A website host, email provider or social platform may operate in locations different from your own. Where we transfer received information and applicable law requires safeguards, the appropriate safeguards must be identified for that transfer. This policy does not claim that every provider keeps every item solely in Montana or the United States.
We may update this policy when the website or actual information practices change. The last-updated date identifies the current version. Material new processing should be explained before it starts where law requires that notice. Questions and rights requests should be directed to the contact details below.
